Applying for Registration or Restoration of a Trade Mark

One can apply for registration or restoration of a Trade Mark by filing the following forms

Application for Registration of a Mark (Form No. 3 of Schedule II to the Trade Mark Rules, CAP. 257S).
Fee for Registration of a Mark (Form No. 9 of Schedule II to Trade Mark Rules, CAP. 257S).
Application for an Address for Service (Form No. 1 of Schedule II to the Trade Marks Rules, CAP. 257S).
Form of Authorization of Agent in a Matter or Proceeding under the Act (Form No. 2 of Schedule II to the Trade Mark Rules, CAP 257S).

The following government fees must be paid as well:

BZD$75.00- fee for application to a register a mark.
BZD$250.00- fee for publication of the notice of application for registration in the Intellectual Property Journal.
BZD$75.00- fee for registration of a mark.
BZD$25.00- fee for application for address for service. This is only required for businesses located outside of Belize or Belizeans who are applying through an attorney.

Application for Renewal of an Existing Trade Mark

One can apply for a renewal for an existing trade mark by filing the following forms:

Renewal of Registration of a Mark (Form No. 11 of Schedule II to the Trade Marks Rules, CAP 257S).
Fee for Renewal (Form No. 12 of Schedule II to the Trade Marks Rules, CAP 257S).
Application for an Address for Service (Form No. 1 of Schedule II to the Trade Marks Rules, CAP 257S).
Form of Authorization of Agent in a Matter or Proceeding under the Act (Form No. 2 of Schedule II to the Trade Marks Rules, CAP. 257S).

The following government fees must be paid as well:

BZD$50.00- fee for renewal of registration of a mark before expiration.
BZD$100.00- fee for renewal of registration of a mark after expiration passes.
BZD$25.00- fee for each additional class proceeded in respect of the renewal.
BZD$250.00- fee for publication of the notice of renewal in the Intellectual Property Journal.
BZD$25.00- fee for application for address for service. This is only required for businesses located outside of Belize or Belizeans who are applying through an attorney.

When Does A Renewal of A Trade Mark Take Effect?

A Trade Mark renewal takes effect from the expiry of the previous registration.

If a Trade Mark is not renewed six months after the expiration of the registration, the Trade Mark shall be removed from the Register of Trade Marks. If this occurs, a Trade Mark can be re registered at the Intellectual Property Office using the same forms and fees that are used when applying for a Trade Mark.
