Patents
Application for a Grant of a Patent
One can apply for a grant pf a patent by filing the following forms and documents:
- Petition for a Patent (Form No. 1 of Schedule II to the Patents Regulations, CAP 253S).
- Specification (description, claims and abstract) and Drawings (if necessary)
- Application for an Address for Service (Form No. 2A of Schedule II to the Patents Administrative Instructions, 2005)
- Power of Attorney (Form No. 2B of Schedule II to the Patents Administrative Instructions, 2005)
The following government fees must be paid as well:
- BZD$300.00- fee for filing an application for a patent
- BZD$300.00- fee for the grant of a patent
- BZD$250.00- fee for publication of a grant of a patent
- BZD$50.00- fee for recording an address for service of a patent. This fee does not apply for a divisional patent
The Date of Grant of a Patent
The date of grant of a Patent is the date of publication of a notice of the grant of the patent in the Intellectual Property Journal.
The Duration of Protection of a Patent
A patent expires twenty years after the filing date of the application. For an international application filed under the Patent Corporation Treaty, the time allotted is twenty years from the filing date.
Application for Restoration or Re- Registration of a Patent
One applies for restoration or re-registration of a patent by filing the following forms:
- Petition for Restoration of a Patent (Form No. 11 of Schedule II to the Patents Regulations, CAP. 253S)
- Application for an Address for Service (Form No. 2A of Schedule II to the Patents Administrative Instructions, 2005)
- Power of an Attorney (Form No. 2B of Schedule II to the Patents Administrative Instructions, 2005)
The following government fees must be paid as well:
- BZD$600.00- fee for restoration of a patent (plus any outstanding annuities and late fees).
- BZD$100.00- fee for publication of the notice of restoration in Intellectual Property Journal.
- BZD$50.00- fee for recording an address for service of a patent
