Industrial Design
The Special Conditions that an Industrial Design must Fulfill before it is Registered
An industrial design qualifies for registration if the product is new. To be considered as “new”, the industrial design should not have been publicly exposed anywhere in the world through publication or by use in any other way prior to the filing date of registration. Additionally, if an industrial jeopardizes morality or social order it is not qualified for registration.
Application for Registration or Restoration of an Industrial Design
One applies for registration or restoration of an Industrial Design by filing the following forms:
- Application for Registration of an Industrial Design (Form No. 1 of Schedule II to the Industrial Design Regulations, CAP. 254S).
- Statement of Designer (Form No. 2 of Schedule II to the Industrial Design Regulations, CAP 254S)
- Appointment of Agent (Form No. 3 of Schedule II to the Industrial Designs Regulations, CAP 254S).
- Application for an Address for Service (Form No. 3 A of Schedule II to the Industrial Designs Administrative Instructions, 2005)
The following government fees must be paid as well:
- BZD$100.00- application fee for the first design application
- BZD$50.00- application fee for each additional design
- BZD$100.00- registration fee for the first design in the application
The Term of Protection of an Industrial Design
The term of protection of an industrial design is five years from the filing date of the registration application. The term may be extended for two further consecutive periods of five years.
Application for Renewal of Registered Industrial Design
One applies for renewal of registered industrial design by filing the following forms:
- Renewal of Registration of an Industrial Design (Form No. 8 of Schedule II to the Industrial Designs Regulations, CAP 254S)
- Appointment of Agent (Form No. 3 of Schedule II to the Industrial Designs Regulations, CAP 254S)
- Application for an Address for Service (Form No. 3A of Schedule II to the Industrial Designs Administrative Instructions, 2005)
The following government fees must be paid as well:
- BZD$100.00- fee for the first design in application being renewed
- BZD$20.00- fee for each additional design being renewed
- BZD$150.00- late fee for the first design in application being renewed
- BZD$20.00- late fee for each additional design being renewed
- BZD$100.00- fee for publication of notice of the renewal in the Intellectual Property Journal
- BZD$25.00- fee for application for address for service.
- If one fails to pay fees for renewal within six months from the expiration date of the registration, the industrial design will lapse. However, it can be restored by re-registration, using the same forms and fees from the initial registration.
